Detractors of the rule say a Supreme Court ruling in favor of industry could also leave the Obama administration in a sort of tail-spin, in the position of having to re-issue a rule – a process that could take significant amounts of time. But other legal minds say that’s not true. “The broader implications could be small,” said Stuart Shapiro, public policy program director at Rutgers University, in The Hill.
